dc.description.resumo | A presente tese tem por objetivo compreender o papel do Poder Judiciário, em especial, do Supremo Tribunal Federal, num cenário de crise institucional em face da necessidade de observância da separação de poderes de um lado e da vedação à denegação de justiça (non liquet) de outro. O direito, segundo a Teoria dos Sistemas de Niklas Luhmann, tem como elemento fundante a generalização congruente das expectativas normativas. A política, por sua vez, opera a partir da tomada de decisões coletivamente vinculantes. Num contexto de extrema complexidade social e de grande contingência, há uma relação de reciprocidade entre os sistemas, o que gera infinitas possibilidades de ação. Muito embora paradoxal, os sistemas parciais devem funcionar operacionalmente fechados, porém, cognitivamente abertos. Trata-se de uma relação absolutamente necessária ao estabelecimento da rede de comunicações dentro da sociedade. Nesse contexto, o risco é inexorável, próprio dessas relações. Cabe ao direito, portanto, a estabilização dessas expectativas. Assim, em que pese os sistemas político e jurídico encontrarem-se acoplados estruturalmente pela Constituição, as distinções precisam ser consideradas, sob pena de desnaturação das operações, com a culminância na corrupção dos códigos. A decisão judicial se torna, portanto, ponto de partida para estruturação da discussão, seguida de uma análise acerca dos sistemas político e jurídico imersos na mencionada crise. O Judiciário exerce papel relevante nesse contexto de hipercomplexidade das relações, mesmo porque é demandado a cada dia com maior frequência para se manifestar acerca de questões de cunho político, notadamente o Supremo Tribunal Federal. Nesse sentido, a tese, elaborada com base em pesquisa bibliográfica, revisão teórica e análise documental, trata de tema de enorme complexidade: compreender a função do Poder Judiciário (STF) nesse cenário, sob a perspectiva da Teoria dos Sistemas de Niklas Luhmann. Não menos complexa, certamente, é a teoria escolhida, contudo, é necessário um olhar crítico ao papel do direito nesse contexto. Acredita-se que, embora a teoria selecionada não esteja imune às críticas, corresponde a um modelo que acolhe satisfatoriamente às expectativas aqui apresentadas e, sem fechar os olhos às ditas críticas, a teoria tem condições de indicar potenciais respostas ao problema apresentado, exatamente por se tratar de uma teoria evolutiva do direito e da sociedade. | por |
dc.description.abstract | This thesis aims to understand the role of the Judiciary, in particular, the Federal Supreme Court, in a scenario of institutional crisis in the face of the need to observe the separation of powers on the one hand and the prohibition of denial of justice (non liquet) on the other. Law, according to Niklas Luhmann's Systems Theory, has as its founding element the congruent generalization of normative expectations. Politics, in turn, operates on the basis of collectively binding decision-making. In a context of extreme social complexity and great contingency, there is a relationship of reciprocity between the systems, which generates infinite possibilities for action. Although paradoxical, partial systems must function operationally closed, however, cognitively open. It is an absolutely necessary relationship for the establishment of the communications network within society. In this context, the risk is inexorable, characteristic of these relationships. It is up to the law, therefore, to stabilize these expectations. Thus, in spite of the political and legal systems being structurally linked by the Constitution, the distinctions need to be considered, under penalty of denaturing the operations, with the culmination in the corruption of the codes. The judicial decision becomes, therefore, a starting point for structuring the discussion, followed by an analysis of the political and legal systems immersed in the aforementioned crisis. The Judiciary plays an important role in this context of hypercomplexity of relationships, even because it is demanded every day more frequently to express its opinion on issues of a political nature, notably the Federal Supreme Court. In this sense, the thesis, based on bibliographic research, theoretical review and document analysis, deals with a subject of enormous complexity: understanding the role of the Judiciary in this scenario, from the perspective of Niklas Luhmann's Systems Theory. No less complex, certainly, is the chosen theory, however, a critical look at the role of law in this context is necessary. It is believed that, although the selected theory is not immune to criticism, it corresponds to a model that satisfactorily meets the expectations presented here and, without closing its eyes to said criticisms, the theory is able to indicate potential responses to the problem presented, precisely because of it is an evolutionary theory of law and society. | eng |
