Declínio dos direitos fundamentais sociais, neoliberalismo e a crise da democracia no Brasil.

Abstract

ResumoA presente tese investiga o processo de desmonte dos direitos sociais no Brasil contemporâneo e suas repercussões sobre a integridade do Estado Democrático e Social de Direito. Parte-se da premissa de que a efetividade dos direitos sociais representa condição essencial para a concretização da cidadania substantiva e para a sustentação de uma democracia que não se limite à dimensão formal, mas se realize na vida concreta da população. A pesquisa analisa, sob perspectiva teórico-crítica e empírica, o percurso histórico que conduziu à regressão normativa e institucional iniciada a partir de 2016 até 2022, quando políticas de austeridade fiscal e reformas estruturais de orientação neoliberal passaram a reconfigurar o papel do Estado e a submeter a Constituição de 1988 a um processo de desconstitucionalização progressiva. Examinam-se, nesse contexto, com especial destaque, os impactos da Emenda Constitucional nº 95/2016, da Lei nº 13.467/2017 e da Emenda Constitucional nº 103/2019, interpretadas como as principais expressões normativas de um projeto político de reconfiguração do pacto social de 1988. A análise revela que tais medidas, sob o argumento de estabilização fiscal, resultaram na compressão dos investimentos sociais, na precarização das relações de trabalho e na ampliação das desigualdades, afetando diretamente o acesso a direitos fundamentais sociais. O estudo também demonstra que a racionalidade econômica subjacente a essas reformas produziu uma inversão hierárquica entre o econômico e o social, transformando o orçamento público em instrumento de contenção e não de efetivação de direitos. O trabalho inclui ainda, a análise de algumas decisões do Supremo Tribunal Federal, nas quais se observa uma postura oscilante entre a proteção formal dos direitos sociais e a condescendência com políticas que restringem seu alcance material. Essa ambiguidade revela a disputa de racionalidades jurídicas no interior da própria Corte e expõe a fragilidade da jurisdição constitucional diante de pressões econômicas e políticas. A presente pesquisa, apoiada em dados do IBGE, IPEA, CEPAL e nos relatórios do projeto Varieties of Democracy (V-Dem), demonstra correlação entre a redução dos investimentos sociais e a deterioração dos índices de qualidade democrática no período que envolve seu recorte temporal, evidenciando que o enfraquecimento dos direitos sociais corrobora, em termos concretos, ao enfraquecimento da democracia. Assim, se confirma a tese de que o desmonte das políticas sociais,somado à retração da proteção jurídica dos direitos fundamentais, configura uma forma contemporânea de erosão democrática, em que o Estado mantém suas aparências institucionais enquanto esvazia os mecanismos materiais de inclusão e igualdade. Assim, o fortalecimento dos direitos sociais é reafirmado como condição indispensável para a reconstrução do pacto constitucional e para a retomada de uma democracia substantiva, fundada na dignidade, na justiça social e na efetiva proteção dos mais vulnerabilizados.AbstractThe present thesis investigates the process of dismantling social rights in contemporary Brazil and its repercussions on the integrity of the Democratic and Social Rule of Law. It starts from the premise that the effectiveness of social rights represents an essential condition for the realization of substantive citizenship and for sustaining a democracy that is not limited to its formal dimension, but is instead materialized in the concrete lives of the population. The research analyzes, from a theoretical-critical and empirical perspective, the historical trajectory that led to the normative and institutional regression that began in 2016 and extended until 2022, when fiscal austerity policies and neoliberal-oriented structural reforms began to reconfigure the role of the State and subject the 1988 Constitution to a process of progressive deconstitutionalization. Within this context, particular attention is given to the impacts of Constitutional Amendment No. 95/2016, Law No. 13,467/2017, and Constitutional Amendment No. 103/2019, interpreted as the main normative expressions of a political project aimed at reconfiguring the 1988 social pact. The analysis reveals that such measures, under the argument of fiscal stabilization, resulted in the compression of social investments, the precarization of labor relations, and the widening of inequalities, directly affecting access to fundamental social rights. The study also demonstrates that the economic rationality underlying these reforms produced a hierarchical inversion between the economic and the social, transforming the public budget into an instrument of containment rather than of the realization of rights. The work further includes an analysis of certain decisions of the Federal Supreme Court, in which one observes an oscillating stance between the formal protection of social rights and leniency toward policies that restrict their material scope. This ambiguity reveals the clash of legal rationalities within the Court itself and exposes the fragility of constitutional jurisdiction in the face of economic and political pressures. Supported by data from IBGE, IPEA, CEPAL, and reports from the Varieties of Democracy (V-Dem) project, this research demonstrates a correlation between the reduction of social investments and the deterioration of democratic quality indicators within the examined period, showing that the weakening of social rights concretely contributes to the weakening of democracy. Thus, the thesis confirms that the dismantling of social policies, combined with the retrenchment of legal protection for fundamental rights, constitutes a contemporary form of democratic erosion, in which the State maintains its institutional appearances while emptying the material mechanisms of inclusion and equality. Therefore, the strengthening of social rights is reaffirmed as an indispensable condition for the reconstruction of the constitutional pact and for the reestablishment of a substantive democracy founded on dignity, social justice, and the effective protection of the most vulnerable.
