Violações de direitos da mulher na era digital : crimes nas redes sociais, de conotação sexual e divulgação de imagens íntimas não consentidas.

Abstract

ResumoA evolução da internet, os algoritmos e suas formas de alimentação de dados e a Inteligência Artificial causaram uma revolução no mundo. Até então nada tinha gerado tantas mudanças em toda a sociedade. Todavia, essa revolução trouxe benefícios e malefícios, e um malefício que tem destaque nessa pesquisa é a amplificação dos crimes contra a mulher já existentes e o surgimento de novos crimes. Mesmo se fale que a era digital é um reflexo da vida real, não se pode negar que seu alcance e velocidade são incomparáveis e incontáveis. É nesse contexto que se insere esta pesquisa, cuja pergunta ou problema que se pretende responder é “como a inteligência artificial e os algoritmos, ao configurar as relações de poder patriarcal, criam ou amplificam violências contra a mulher que desafiam as categorias tradicionais do direito?”. Com base no problema de pesquisa, o objetivo geral é a partir dos conceitos e perspectiva social analisar como a internet, inteligência artificial e algoritmos corroboram para violações de direitos como violação a intimidade e ao corpo e igualdade de gênero, em razão dos crimes que terão destaque ao longo da pesquisa. Utilizando uma abordagem qualitativa, a pesquisa teve como base doutrinas, leis, pesquisas e dados governamentais, sendo, portanto, documental e bibliográfica. Dentre as principais surpresas encontradas foram a quantidade de crimes e violências relacionados a discriminação de gênero, mas a pesquisa se debruçou de forma especifica em crimes cometidos nas redes sociais, de conotação sexual e vazamento de imagens íntimas não consentidas. Ressaltando-se que se torna possível identificar como os crimes se interligam e muitas vezes são praticados em conjunto. Quanto as contribuições se relevantes modalidades de violência contra a mulher na pesquisa e como essas violências avançam junto com a era digital, além de abordar a fragilidade legislativa, seja por ausência ou falha, ou por incapacidade de solucionar o problema social sozinha. Apesar de ter como foco apontar as violências de gênero na internet, a pesquisa também traz o uso da internet no combate da violência de gênero.AbstractThe evolution of the internet, algorithms and their data-feeding methods, and Artificial Intelligence have revolutionized the world. However, this revolution brought both benefits and drawbacks, and one drawback highlighted in this research is the amplification of existing crimes against women and the emergence of new ones. Even if it's said that the digital age is a reflection of real life, it's undeniable that its reach and speed are unparalleled and countless. This research is set in this context, whose question or problem is "how do artificial intelligence and algorithms, by shaping patriarchal power relations, create or amplify violence against women that challenges traditional legal categories?" Based on the research problem, the overall objective is to analyze, from a conceptual and social perspective, how the internet, artificial intelligence, and algorithms contribute to rights violations such as violations of privacy and the body and gender equality, based on the crimes that will be highlighted throughout the research. Using a qualitative approach, the research was based on doctrines, laws, research, and government data, making it documentary and bibliographical. Among the main surprises found was the number of crimes and violence related to gender discrimination, but the research focused specifically on crimes committed on social media, sexually charged crimes, and the leaking of non-consensual intimate images. It is noteworthy that it becomes possible to identify how these crimes are interconnected and often committed in conjunction. The contributions are relevant to the types of violence against women in the research and how these types of violence evolve with the digital age. It also addresses legislative weaknesses, whether due to absence, failure, or the inability to solve the social problem alone. Although focused on identifying gender-based violence on the internet, the research also addresses the use of the internet in combating gender-based violence.
